Former Auburn deputy mayor Salim Mehajer says "only death" will part him from his wife Aysha, after police applied for an Apprehended Violence Order on her behalf.
Mr Mehajer will face Sydney's Downing Centre Local Court on Wednesday when the AVO application, made under his wife's maiden name Aysha Amelia Learmonth, will be heard.
However, the property developer has denied his wife applied for the order against him, posting photographs of her on Facebook and accusing the police of "having nothing better to do".
"Aysha has not taken out an AVO against me," Mr Mehajer told News Corp.
"The police are pursuing for an AVO. The police seem to have nothing better to do then [sic] follow our footsteps.
"As mentioned before, only death will do us apart."
He also told Nine News that he and his wife were "perfectly fine" and police had applied for the AVO after "alleged complaints by neighbours".
On Tuesday morning, several hours after news broke of his upcoming court appearance, Mr Mehajer posted a smiling photo of himself on Facebook with the caption "you are never fully dressed without a smile".
Three days earlier, Mr Mehajer posted two pictures of Aysha and declared she "put the smile on my face, the sparky [sic] in my eyes and the love in my heart".
"Love is not about finding someone to live with, but rather finding someone that you cannot live without," he wrote.
However, previous posts – including one where he declared his marriage "unbreakable" – appear to have been deleted.
The current AVO application comes as two other people are applying for AVOs against Mr Mehajer.
Bruce Herat, a personal trainer at Mr Mehajer's gym, and a man believed to be Mr Mehajer's brother-in-law will have their AVO applications heard in Sydney and Wollongong at the end of the month.
